By using the website (www.whalecoasttheatre.com) you agree to the terms and conditions below and acknowledge that you have read, understand and accept the Terms and Conditions.

1. RISK

It is the user’s responsibility to ensure that all details on the ticket are correct before accepting the offer. No mistakes can be rectified after acceptance by the user. The purchaser/user indemnifies and holds the provider harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the website.

2. PRIVACY

The user’s personal information, delivery address and telephone numbers will be kept in the strictest confidence by the provider and will under no circumstances be disclosed to third parties. The provider cannot be held responsible for security breaches occurring on the user’s electronic device (personal computer or other electronic device used to browse the website).

3. COVID-19 PROTOCOLS AND REGULATIONS

By agreeing to the terms and conditions, the user declares that neither him/herself nor any of his/her guests have experienced aches/pains, fever, cough nor shortness of breath / chest discomfort (any symptoms of Covid 19) in the last 14 days. The wearing of masks, sanitizing of hands and temperature checks will be mandatory. No person will be allowed entry into the Whale Coast Theatre if they do not wear a mask or if their temperature exceeds 37.5°C; as required by government regulations.

4. RIGHTS OF ADMISSION AND AGE RESTRICTIONS

Whale Coast Theatre reserves all rights in terms of admission to cinemas, regardless of whether the ticketholder has purchased tickets online or in person. It is the user’s responsibility to be aware of and adhere to AGE RESTRICTIONS that are applied to films. Should a Whale Coast Theatre staff member be presented with a valid cinema ticket by a person not meeting the age restriction criteria attached to the movie, Whale Coast Theatre is legally compelled to deny entry to the cinema to said person, and no ticket refunds or re-admission tickets will be granted. Please note that this is regulation by the Film and Publications Board and the Whale Coast Theatre needs to be in adherence to all regulations stipulated by the specific regulatory board. 5. PENSIONERS’ AND CHILDREN’S DISCOUNTS

Whale Coast Theatre reserves the right to request proof of identification for the purposes of verification of age. Discounts applicable to particular age groups can only be claimed when purchasing tickets at the Whale Coast Theatre ticket counters, as ages cannot be verified on our digital platforms.

6. REFUNDS, CANCELLATIONS OR EXCHANGES

Any requests for refunds must be directed to info@whalecoasttheatre.co.za or 028 312 1396. All such requests will be considered on a case-by-case basis at Whale Coast Theatre’s discretion. No cash refunds for online tickets will be made at Whale Coast Theatre. If for any reason a show is cancelled, cinema re-admission tickets will be issued at the sole discretion of the cinema manager.

7. CONNECTION ERRORS | FAILURE TO BOOK A TICKET(S)

Whale Coast Theatre recognizes that whilst it takes all possible steps to prevent errors during the course of booking transactions, errors may arise as a result of, inter alia, computer hardware and – software . Such errors may include the failure of the device to accept certain transactions eg: payment portal or network communication errors . If you do not receive a booking confirmation/number from us after you have paid, please get in touch by calling 028 312 1396 and we will assist you to resolve the issue.

8. FILM AND RELEASE DATE INFORMATION

Information on the website regarding films and their release dates is subject to change without notice and is to be considered as a guide.

9. LIMITATION OF LIABILITY

Whale Coast Theatre does not warranty or make any representation regarding the availability, accuracy or completeness of this website. Neither provider nor any holding company, affiliate or subsidiary of the provider, shall be held responsible for any direct, indirect, special, incidental or consequential damages of any kind whatsoever suffered or incurred, caused by or related to errors, omissions, or the inability to access or use the content or the website or any functionality thereof, or of any linked website.

10. TRAILERS

We would like to notify users that the trailers provided link/access other third-party sites/resources and that suggested content (videos) at the end of trailers is not on our recommendation and does not relate to upcoming shows at the Whale Coast Theatre. As Whale Coast Theatre has no control over such sites and resources, we are not responsible or liable for any content, products, or services shown on other websites you might visit via our website.

11. UPDATING OF TERMS AND CONDITIONS

The Whale Coast Theatre reserves the right to modify these terms and conditions from time to time. It is the user’s obligation to check these terms and conditions for any changes or updates. The user’s continued use of this website following the posting of changes or updates will be considered notice of the user’s acceptance to abide by and be bound by these terms and conditions, including such changes or updates.
